General Terms and Conditions of Bacchus Winery Speicher

 

General, Scope of Application of the Terms and Conditions
All deliveries and services of Weingut Bacchus Speicher, represented by Antonie & Andreas Pietsch, Mühlweg 34 & Gänssaalweg 25, 55246 Wiesbaden/Mz.-Kostheim (hereinafter "Bacchus Speicher"), are provided exclusively on the basis of the following General Terms and Conditions in their version valid at the time of the order.

For the purposes of these terms and conditions, "customer" refers to both consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity. A business, for the purposes of these terms and conditions, is any natural or legal person or partnership with legal capacity that, when entering into a contract with us, is acting in the course of their commercial or independent professional activity.

Conclusion of contract, formation of the contract
Customers can currently submit their purchase offer in the following ways: in person during our opening hours, in writing via email, or through the Bacchus Speicher online shop . The data transmitted by the customer will only be used for processing and delivering the order and will not be passed on to third parties by Bacchus Speicher .

The presentation of products in our online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process. By clicking the order button, you submit a binding order for the goods contained in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after you submit it.

When ordering through our online shop, please proceed as follows:
Select the desired quantity of the product by entering it directly or using the arrow keys, and add it to your shopping cart using the "ADD" button. You can then view your shopping cart.

You can access your shopping cart at any time via the "BAG" symbol (with a red circle including a number) in the upper right information field.
After adding an item to your shopping cart, you can continue shopping by clicking the "CONTINUE SHOPPING" button and view your order status by clicking the "VIEW CART" button. You can adjust the quantity of items using the quantity buttons – please remember to click the "UPDATE CART" button before doing so.
After you have checked the goods and the quantity, you can click the "CHECKOUT" button if you intend to purchase.

You will then be taken to the order processing area, where you must enter your email address or mobile phone number under "Contact".

Below you have the option to choose between shipping and collection:
(1) Shipping: Here you must enter the name and address of the order/delivery/billing address. Clicking the "PROCEED TO SHIPPING" button will take you to a review area where you can check or change your contact information and delivery address. Clicking the "PROCEED TO PAYMENT" button will take you to the payment area. Here you can choose between payment by credit card, PayPal, Klarna, Klarna Sofort, or instant bank transfer. After payment, our order confirmation page will appear. This page contains all the details, and you will also receive a confirmation by email or to your registered mobile phone number. You can now return to our website by clicking the "BACK TO SHOP" button or contact us directly by clicking the "Need help?" link.

(2) Collection: The collection point is Weingut Bacchus Speicher, Gänssaalweg 25, 55246 Wiesbaden/Mz.-Kostheim. Clicking the "PROCEED TO PAYMENT" button will take you to the payment process. Here you can review and/or change your contact details and collection/shipping information. You will also enter your desired billing address. You can choose between payment by credit card, PayPal, Klarna, Klarna Sofort, or instant bank transfer. After payment, our order confirmation page will appear. This page contains all the details, and you will also receive a confirmation by email or to your registered mobile phone number. You can then return to our website by clicking the "BACK TO SHOP" button or contact us directly by clicking the "Need help?" link.

Cancellation policy
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last goods.

To exercise your right of withdrawal, you must inform us (Weingut Bacchus Speicher, Mühlweg 34 & Gänssaalweg 25, 55246 Wiesbaden/Mz.-Kostheim, email: kontakt@bacchusspeicher.de) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of the revocation
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.

You pay the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.

Prices and shipping costs
All prices include VAT and exclude shipping costs. Please refer to the individual item description for shipping costs.

Delivery terms
We deliver exclusively within Germany. Shipping is via DPD, DHL, or another provider of our choice.

The goods will be dispatched within 3-5 days after receipt of payment, unless otherwise stated in the offer.

Payment terms
Payment can be made by direct debit, PayPal, Klarna, instant bank transfer, credit card, or invoice. For direct debit and credit card payments, your account will be debited within 1-2 days of receiving your order. For PayPal and instant bank transfer payments, you will be redirected to the payment provider's website during the checkout process to complete the payment yourself. For invoice payments, you will receive the invoice by email. The invoice amount is due within 10 days of receipt of the invoice.

All delivered goods remain our property until full payment has been received.

LIABILITY FOR DEFECTS/STATUTE OF LIMITATIONS
There is generally a statutory right to claim for defects, unless otherwise stipulated.

PRICES AND SHIPPING COSTS
The prices listed on the product pages include statutory VAT and other price components.
We ship in boxes of 1, 3, 6, 12, and 18 units. In addition to the prices shown, we charge the following shipping costs for deliveries within Germany:

Up to 12 bottles €7.50
Up to 19 bottles €9.50
Up to 36 bottles for €15.00
Up to 54 bottles for €19.50

Shipping costs will be displayed on the product pages.
Delivery is only available within Germany via DHL.
Delivery takes 3 to 5 business days. Any differing delivery times will be indicated on the respective product page.

YOUTH PROTECTION
The goods we offer are intended for adult use only. By submitting an order, the customer declares that they are at least 18 years old. All information required for the order, such as name, address, etc., must be provided completely and truthfully.

RETENTION OF OWNERSHIP
The goods remain our property until full payment is received.

NOTICE REGARDING THE RETURN OF PACKAGING
We are affiliated with the waste disposal system Zentek GmbH & Co. KG.

DISPUTE RESOLUTION
The European Commission has established an online platform for dispute resolution. This platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
